E-Government LLC, and its employees, agents, and representatives, are not affiliated with the Internal Revenue Service (“IRS”) or any other governmental or regulatory body or agency. E­Government LLC provides paid services to obtain Federal Tax Identification Numbers from the IRS. As a “Third Party Designee,” pursuant to IRS Form SS-4, EIN-ITIN.com prepares and submits applications for an Employer Identification Number (“EIN”) to the IRS on behalf of its clients. E-Government LLC does not verify EIN application submissions and is not responsible for the accuracy of the information provided. Any individual may obtain and submit his or her own EIN application at no cost through the official IRS website at www.irs.gov.

Responsibilities

You agree to make all necessary arrangements to access to the Website; be aware of this and other relevant Terms of Uses within the Website; to be compliant to this and other Terms of Uses within the Website; to provide and maintain accurate contact information

You agree not to attempt to gain unauthorized access to any portion or feature of the Website, or any other systems or networks connected to the Site or to any of the services offered on or through the Website, by hacking, password “mining” or any other illegitimate means. You may not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Website or any transaction being conducted on the Site, or with any other person’s use of the Website. Fees and Refund Policy

We provide the services for the rates listed on the Website, which are incorporated herein by reference. All amounts are due and payable in accordance with our invoices. We will do everything we can to process your application in the mentioned period of time, provided all information provided to us is accurate. If we cannot complete a process and no EIN, ITIN is assigned or company is formed due to an unfixable error, a refund 25 % (percent) of the processing fee will be provided by us. If we do complete the application and an EIN is successfully assigned (service is provided), no refunds can be issued. If you change your mind right after you order, a refund 25 % (percent) of processing fee will be provided by us.

For incomplete orders due to inaccurate information provided by the customers, the customer will be contacted via email by us to rectify the issue, and we will try one additional time to obtain your EIN. If at that point there is another error, the customer will be issued a refund 25 % (percent) of the processing fee on the next business day. SS4 Fax – Ref 101: For EIN applications resulting in a Reference 101 error from the IRS, E-Government LLC may contact you via e-mail with instructions on how we will proceed with manually filing your application with the IRS. You will receive an e-mail with a completed SS-4 form PDF on the same day that the Ref 101 error occurred, and the PDF will require your electronic signature. Then, E­Government LLC will continue to process your EIN with the IRS, and you will receive the

EIN via e-mail in 7-10 business days due to the manual processing wait time for all Reference 101 errors. In the event that there is an additional error within the Ref 101 application and E­Government LLC cannot process your application as a Third Party Designee, we will issue a refund of the service fee, minus a $15 of the processing fee.

Privacy

The Company Privacy Policy applies to use of this Website, and its terms are made a part of these Terms of Use by this reference. By using the Website, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that any message or information you send to the Website may be read or intercepted by others, even if there is a special notice that a particular transmission (for example, credit card information) is encrypted.

Liability

Except where prohibited by law, in no event will E-Government be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if the Company has been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold E-Government, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against the Company by any third party due to or arising out of or in connection with your use of the Website.

Violation of These Terms of Use

E-Government reserves the right at all times to disclose any information that the Company deems necessary to comply with any applicable law, regulation, legal process or governmental request. E­Government also may disclose your information when the Company determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

You agree that E-Government may, in its sole discretion and without prior notice, terminate your access to the Website and/or block your future access to the Website if the Company determines that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Website. You also agree that E-Government may, in its sole discretion and without prior notice, terminate your access to the Website, for cause, which includes (but is not limited to) (1) requests by law enforcement or other government agencies, (2) a request by you (self-initiated account deletions), (3) discontinuance or material modification of the Website or any service offered on or through the Site, or (4) unexpected technical issues or problems. You agree that E-Government will not be liable to you or to any third party for termination of your access to the Website as a result of any violation of these Terms of Use.

If E-Government does take any legal action against you as a result of your violation of these Terms of Use, the Company will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to the Company.

Dispute Resolution: Governing Law and Venue 

You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of the United States and by the laws of the State of Delaware without regard to its conflicts of laws provisions. You agree to the personal jurisdiction by and venue in the state and federal courts in Delaware, and waive any objection to such jurisdiction or venue.
